01Agreement
These Terms of Service ("Terms") govern your access to and use of the AIRRAD website located at airrad.org (the "Site"), including any content, functionality, forms, or submissions made through it. By accessing the Site, submitting a request, or sending a message through any form on the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Site.
02Who We Are
The Site is operated by AIRRAD, LLC, a Utah limited liability company ("AIRRAD," "we," "us," or "our"). You can reach us at [email protected].
03What AIRRAD Does
AIRRAD researches and investigates reports of unexplained phenomena. Our findings represent our good-faith assessment of the evidence available to us at the time of investigation. They are not guarantees, scientific certifications, or professional advice of any kind, including legal, medical, psychological, financial, or safety advice.
AIRRAD treats "unexplained" as a distinct category from "paranormal." We record reported observations, review natural explanations, and report our findings as they are, whether they confirm, explain, or leave open the experience reported.
3.1 Not an Emergency Service. AIRRAD is not an emergency service. If anyone is in immediate danger, contact local emergency services (call 911) before contacting AIRRAD.
04Not a Private Investigation Service
4.1 Work We Do Not Perform
AIRRAD is not a private investigation agency and does not perform any work requiring licensure under Utah's Private Investigation Licensing Act (Utah Code Title 58, Chapter 92) or under the equivalent law of any other state, territory, or jurisdiction. We do not:
(i) locate, track, or skip-trace individuals;
(ii) conduct background checks or compile personal dossiers;
(iii) perform surveillance of any person;
(iv) investigate the identity, reputation, character, habits, conduct, business occupation, honesty, integrity, credibility, knowledge, trustworthiness, efficiency, loyalty, activity, movements, whereabouts, affiliations, associations, or transactions of any individual or group of individuals;
(v) assess or investigate the credibility, truthfulness, or reliability of any person;
(vi) investigate the causes and origin of, or responsibility for, any fire, libel, slander, loss, accident, or damage or injury to real or personal property;
(vii) prevent, detect, locate, identify, or remove eavesdropping devices, hidden cameras, or any other installed device for eavesdropping or observation;
(viii) recover, locate, or trace assets or property;
(ix) gather, preserve, or package evidence for use in court proceedings, legal disputes, administrative proceedings, or litigation of any kind;
(x) serve civil process; or
(xi) perform any other service defined as private investigation under the Act or requiring licensure under the Act.
Any request or submission that seeks work falling within these categories will be terminated immediately and without further notice.
4.2 Overlap With Our Work
AIRRAD investigates reported phenomena at locations, not persons. Two aspects of our work involve activities that can resemble, but are distinct from, private investigation:
(a) Witness accounts. AIRRAD documents accounts provided by witnesses to reported events. We record what a person reports and classify how close they were to the event (first-hand, relayed, or unclear). We do not evaluate or investigate the credibility, truthfulness, or character of any witness. Our interest is in the reported event, not the person reporting it.
(b) Property conditions. When reported phenomena at a location include damage to property, AIRRAD documents that damage, as observed, as part of the case record. We do not investigate the causes and origin of the damage, who caused it, whether any person or entity bears fault, or whether any party is financially or legally responsible. Our review of natural explanations covers the reported phenomena only, not the damage, and no AIRRAD report or record states a cause for any damage, natural or otherwise. Where the reported phenomenon is itself the event that damaged property (for example, an object reported to fall and break), we record the account, the location and condition of the item, and any measurements, and we do not offer or test a natural explanation for that event. If something we notice may bear on the damage, we will suggest that you consult a qualified professional, such as an inspector, contractor, insurer, or fire marshal. Our interest is in the reported phenomena at the location, not in the cause of any damage or in liability for any loss.
4.3 Required Certification. Before submitting a request or message through the Site, you must certify that you have read and acknowledged this notice and that you will not pursue private investigation work with AIRRAD. We record that certification as part of your submission, including the certification text, its version number, the date and time of your agreement, and your IP address. That record is maintained with the submission it accompanied and is subject to our Privacy Policy, including its provisions on redaction.
05Eligibility
You must be at least 18 years old to submit a request, message, or any other content through the Site. By submitting content, you represent and warrant that you meet this requirement.
06Submitting a Request
6.1 Accuracy. All information you provide through the Site must be true and accurate to the best of your knowledge.
6.2 Rights in Submitted Information. You must have the legal right to share the information you submit through the Site. You represent and warrant that your submission does not infringe any third party's rights.
6.3 No Obligation to Act. Submitting a request does not create a client relationship, contract, or any obligation on the part of AIRRAD to investigate or respond. We may decline any request for any reason, at our sole discretion. A case is open only when we confirm it to you in writing.
6.4 Certification Required. Each form submission requires you to complete the certification described in Section 4.3 of these Terms. A submission cannot be completed without this certification.
6.5 Materials Provided After a Case Opens. The Site's forms collect information in text form only and do not accept file uploads. Photographs, audio, video, documents, or other materials requested during an active investigation are provided outside the Site and are subject to the terms of that engagement.
07Your Content and Our Research Record
7.1 Ownership. You retain ownership of the content you submit to AIRRAD through the Site.
7.2 License Grant. By submitting content through the Site, you grant AIRRAD a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to store, copy, analyze, reproduce, and use that content for our research, investigations, internal case records, and related operational purposes, and to publish it in accordance with Section 7.4 and our Privacy Policy.
7.3 Permanent Research Record. Submissions become part of AIRRAD's permanent research record, which we keep as described in our Privacy Policy, including its provisions on redaction and on the limited changes AIRRAD's Owner may make. This record supports the integrity and continuity of our investigative work across cases and over time.
7.4 Publication and Privacy. If AIRRAD publishes findings or case studies through channels outside this website, we redact names and identifying details by default. AIRRAD does not publish case data, investigation findings, or case studies on airrad.org. You may indicate your privacy preferences at the time of submission. No identifying details are published without your express consent. Our Privacy Policy describes how we handle personal information in detail.
7.5 Redaction, Not Deletion. Submissions form part of a permanent research record, and AIRRAD does not delete them on request. Where personal information is concerned, our Privacy Policy describes an irreversible redaction process as the available remedy. Redaction removes identifying details from the active record but does not remove the underlying submission from the research record.
08Acceptable Use
When using the Site, you agree not to:
(i) knowingly submit fabricated, altered, or misleading evidence or information; (ii) harass, threaten, defame, or impersonate any person; (iii) submit another person's personal information without that person's permission; (iv) submit unlawful content or content you do not have the right to share; (v) attempt to gain unauthorized access to the Site, its systems, databases, or any connected network; (vi) disrupt, overload, or interfere with the operation or availability of the Site; (vii) use automated tools, bots, or scrapers to access, copy, or index the Site or its content without our prior written permission; or (viii) use the Site for any purpose that violates applicable law.
09Intellectual Property
9.1 AIRRAD Property. The Site and its content, including all text, images, audio and video recordings, graphics, the AIRRAD name, the hexagon mark, logos, and the Site's overall design and layout, are the intellectual property of AIRRAD, LLC or its licensors. All rights not expressly granted in these Terms are reserved.
9.2 Limited Personal Use. You may view the Site and share links to it for personal, non-commercial purposes. You may quote brief passages from published Site content with proper attribution and a link to the original page.
9.3 Restrictions. Any use beyond what is described in Section 9.2, including reproduction, distribution, modification, public display, or commercial use of Site content, requires our prior written permission. Requests for permission may be directed to the contact information in Section 18.
10Third-Party Links
The Site may contain links to websites or services operated by third parties. AIRRAD does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party site. Your use of any linked site is at your own risk and subject to that site's own terms and policies.
11Disclaimers
THE SITE AND ALL CONTENT, FINDINGS, REPORTS, AND MATERIALS PROVIDED THROUGH IT ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. AIRRAD DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY FINDINGS OR REPORTS WILL BE ACCURATE, COMPLETE, OR RELIABLE. YOUR USE OF THE SITE AND ANY RELIANCE ON ITS CONTENT IS AT YOUR SOLE RISK.
12Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AIRRAD, LLC AND ITS MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO: (I) YOUR USE OF OR INABILITY TO USE THE SITE; (II) ANY CONTENT YOU SUBMIT THROUGH THE SITE; (III) ANY FINDINGS, REPORTS, OR CONCLUSIONS PROVIDED BY AIRRAD; OR (IV) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR SUBMISSIONS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF AIRRAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AIRRAD'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE TOTAL AMOUNT YOU HAVE PAID TO AIRRAD IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
12.1 Rights That Cannot Be Waived. Nothing in these Terms limits or excludes any right or remedy you have under the Utah Consumer Sales Practices Act (Utah Code 13-11) or any other law that cannot be waived or limited by contract, or AIRRAD's liability for gross negligence or willful misconduct. If you enter into a Client Services Agreement with AIRRAD, your engagement is governed by that agreement, including its liability provisions, and the limitation in Section 12 of these Terms does not apply to claims arising from that engagement.
13Indemnification
You agree to indemnify, defend, and hold harmless AIRRAD, LLC, its members, employees, agents, contractors, and volunteers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (i) your breach of these Terms; (ii) your violation of any applicable law in connection with your use of the Site; or (iii) content you submit through the Site that you did not have the right to share. This indemnity does not apply to claims arising from AIRRAD's own negligence, willful misconduct, or breach of these Terms.
14Termination
AIRRAD may suspend or terminate your access to the Site, or close any request or case, at any time and for any reason, with or without notice. Submissions that violate Section 4 (private investigation prohibition) or Section 8 (acceptable use) are subject to immediate termination without notice. The following sections survive any termination of your access to the Site or any expiration of these Terms: Sections 7, 8, 9, 11, 12, 13, 15, and 17.
15Dispute Resolution and Governing Law
15.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles.
15.2 Informal Resolution. Before initiating any formal legal proceeding arising from or related to these Terms or your use of the Site, you agree to contact AIRRAD in writing using the contact information in Section 18 and make a good-faith effort to resolve the dispute informally. The parties will have thirty (30) days from the date of written notice to attempt resolution before either party may proceed with formal action. This requirement does not limit your right to contact any government agency or regulatory body at any time, or to take formal legal action sooner when necessary to meet a filing deadline, preserve evidence, or seek emergency relief.
15.3 Jurisdiction and Venue. If a dispute cannot be resolved informally under Section 15.2, you agree that any legal action or proceeding arising from or related to these Terms will be brought exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction and venue of those courts.
16Changes to These Terms
We may update these Terms at any time. When we do, we will post the revised version on this page with an updated effective date. Your continued use of the Site after any revision constitutes your acceptance of the updated Terms. If we make changes that materially affect your rights or obligations, we will make reasonable efforts to provide notice through the Site. We encourage you to review this page periodically.
17General Provisions
17.1 Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
17.2 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIRRAD regarding your use of the Site and supersede all prior agreements, understandings, or representations on this subject.
17.3 No Waiver. AIRRAD's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by AIRRAD.
17.4 Assignment. You may not assign or transfer any of your rights or obligations under these Terms without AIRRAD's prior written consent. AIRRAD may assign its rights and obligations under these Terms without restriction.
17.5 Electronic Communications. By using the Site and submitting forms through it, you consent to receiving communications from AIRRAD electronically. You agree that all notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
